murphybrownspiegelIn what appears to be a cyclical recurrence of post-success litigation, Snapchat is being sued by a man from South Carolina named Frank Reginald Brown IV, who claims that he originally came up with the idea for the ephemeral picture messaging app. The idea for Snapchat is simple, yet has been widely misunderstood by older generations: you take a picture or video of yourself (or something else if you choose), set a time limit, and send the picture off to a friend. The app will only let the user view the picture for the pre-set period of time, no more than ten seconds.

Health concerns about the typical energy drink?are everywhere, so?you may not want to depend on them for energy. After all, not only can they be extremely high in caffeine, but they also tend to be full of sugar, artificial colorings and other unnatural ingredients. Chia Pomegranate Green Tea Cooler

It helps energize you without making you jittery. When you are stressed, both the energy boost from the caffeine and the relaxing effect of the theanine can be helpful. Pomegranate juice is full of nutrients, flavonoids, and antioxidants and is low in sugar. This healthy juice can help give you a boost from nutrition alone. The chia seeds were traditionally used as a support for long journeys. The gel-like substance they form when put in liquid absorbs slowly into the body, for a slow release of nutrients and energy. Directions: In a blender, mix 1 cup of whole milk with 1/2 to 1 tablespoon of fair trade cocoa powder, a dash of vanilla extract and 1 tablespoon of maple syrup or honey. Blend until combined.

Why it works: Milk gives you good source of both protein and fat for sustained energy. Milk also contains some natural sugar that gives a boost of energy. Use grade B maple syrup for a higher nutrient content, and you will add both more natural sugars for a more instant energy boost. The cocoa powder gives some caffeine, as well as more antioxidants and nutrients (such as magnesium). I prefer raw, pastured milk.

Directions: The darling of the raw foodie and many health conscience people, the green drink trend shows no sign of slowing down and there are many green drink mixtures available online. Make according to the package directions, or add a scoop to a smoothie.

Why it works: Green drinks work because they are high in nutrients, very alkalizing (which makes you feel refreshed and energized). Plus, some mixes contain herbs known for their energizing attributes. Mix them with a pomegranate, noni, or other antioxidant-rich juice, or combine with a high protein snack like nuts or canned fish for sustained energy.

The above recipes are gentle, natural options for an energy boost and are perfect for a mid-day drink. Being more natural, and not as high in caffeine, they may not keep you in a working frenzy all night long when you need it, but on the plus side, they offer many health benefits.?

A study published today in Biology Letters found that ship noise affects crab metabolism, with largest crabs faring worst, and found little evidence that crabs acclimatise to noise over time.

The team from the Universities of Bristol and Exeter found that crabs exposed to recordings of ship noise showed an increase in metabolic rate, indicating elevated stress. In the real world this could have implications for growth and, if the metabolic cost of noise causes crabs to spend more time foraging to compensate, could also increase the risk of predation.

Researcher Matt Wale from Bristol's School of Biological Sciences describes the study: "We used controlled experiments to consider how shore crabs of different sizes respond to both single and repeated exposure to playback of ship noise. Ship noise is the most common source of noise in the aquatic environment."

Explains Dr Andy Radford, Reader in Behavioural Ecology at Bristol: "We found that the metabolic rate of crabs exposed to ship noise was higher than those experiencing ambient harbour noise, and that larger individuals were affected most strongly. This is the first indication that there might be different responses to noise depending on the size of an individual."

If commercially important crabs and lobsters are affected by noise, these findings have implications for fisheries in busy shipping areas where large individuals may be losing out. Conversely, if reducing noise reduces metabolic costs, then quietening aquaculture facilities may lead to higher yields.

Dr Steve Simpson from the University of Exeter warned: "Since larger crabs are affected more strongly by noise this could have implications for fisheries in noisy areas. Also, many crustacean species, particularly prawns, are grown in aquaculture, so if acoustic disturbance has a metabolic cost then operational noise in farms may impact on growth, and quieter farms may be more profitable."

Vowel-dropping startup Splitsecnd has launched a dongle that plugs into your car's cigarette lighter and calls 911 if it senses you've crashed. When triggered, the hardware uploads your location to the emergency services while a rep will calmly talk you through the process. The unit also comes with a button that lets you call during medical emergencies and other worrying times. It's available for $200 with a $15 monthly fee, and there's a commercial after the break showing how the concept works -- with a woman who takes an awfully long time to say thank you.

(AP) ? Beer lovers across the U.S. have accused Anheuser-Busch of watering down its Budweiser, Michelob and other brands, in class-action suits seeking millions in damages.

The suits, filed in Pennsylvania, California and other states, claim consumers have been cheated out of the alcohol content stated on labels. Budweiser and Michelob each boast of being 5 percent alcohol, while some "light" versions are said to be just over 4 percent.

The lawsuits are based on information from former employees at the company's 13 U.S. breweries, some in high-level plant positions, according to lead lawyer Josh Boxer of San Rafael, Calif.

"Our information comes from former employees at Anheuser-Busch, who have informed us that as a matter of corporate practice, all of their products mentioned (in the lawsuit) are watered down," Boxer said. "It's a simple cost-saving measure, and it's very significant."

The excess water is added just before bottling and cuts the stated alcohol content by 3 percent to 8 percent, he said.

Anheuser-Busch InBev called the claims "groundless" and said its beers fully comply with labeling laws.

"Our beers are in full compliance with all alcohol labeling laws. We proudly adhere to the highest standards in brewing our beers, which have made them the best-selling in the U.S. and the world," Peter Kraemer, vice president of brewing and supply, said in a statement.

The suit involves 10 Anheuser-Busch products: Budweiser, Bud Ice, Bud Light Platinum, Michelob, Michelob Ultra, Hurricane High Gravity Lager, King Cobra, Busch Ice, Natural Ice and Bud Light Lime.

Anheuser-Busch, based in St. Louis, Mo., merged with InBev in 2008 to form the world's largest alcohol producer, headquartered in Belgium. In 2011, the company produced 10 billion gallons of malt beverages, 3 billion of them in the U.S., and reported $22 billion in profits from that category, the lawsuit said.

According to the lawsuit, the company has sophisticated equipment that measures the alcohol content throughout the brewing process and is accurate to within one-hundredth of a percent. But after the merger, the company increasingly chose to dilute its popular brands of beer, the lawsuit alleged.

"Following the merger, AB vigorously accelerated the deceptive practices described below, sacrificing the quality products once produced by Anheuser-Busch in order to reduce costs," said the lead lawsuit, filed Friday in federal court in San Francisco on behalf of consumers in the lower 48 states.

Companion suits are being filed this week in Pennsylvania, New Jersey and elsewhere. Each seeks at least $5 million in damages.

The named Pennsylvania plaintiffs, Thomas and Gerald Greenberg of Ambler, said they buy six cases of the affected Anheuser-Busch products a month. They did not immediately return a message Tuesday, and Boxer would not elaborate on their purchases except to say the consumer-protection suit does not involve retailers or bar owners.

One of the California plaintiffs, Nina Giampaoli of Sonoma County, said she bought a six-pack of Budweiser every week for the past four years.

"I think it's wrong for huge corporations to lie to their loyal customers ? I really feel cheated. No matter what the product is, people should be able to rely on the information companies put on their labels," Giampaoli said in a news release issued by Boxer's law firm.

Bloomberg News first reported Tuesday on the lawsuits.

In a telephone interview with The Associated Press, Boxer said he has evidence to corroborate the former employees' allegations, but stopped short of saying the beers had been independently tested.

"AB (Anheuser-Busch) never intends for the malt beverage to possess the amount of alcohol that is stated on the label. As a result, AB's customers are overcharged for watered-down beer and AB is unjustly enriched by the additional volume it can sell," the lawsuit said.

(AP) ? Brittney Griner scored 15 points, tied her season-high with 15 rebounds and blocked seven shots to lead top-ranked Baylor to its 25th straight victory, 86-64 Monday night against Oklahoma.

After sitting out the last 11? minutes of the first half with two fouls, Griner returned and hit the first two baskets in a 10-0 run that pushed the Lady Bears' lead out to 47-30. Baylor (27-1, 16-0 Big 12) led by at least 12 the rest of the way,

Griner moved past Connecticut's Maya Moore into fourth in career scoring in women's basketball. Only Jackie Stiles of Missouri State, Patricia Hoskins of Mississippi Valley State and Lorri Bauman of Drake have more than Griner's 3,045 points.

Aaryn Ellenberg had 19 points to lead Oklahoma (19-9, 9-7). Morgan Hook had 15 points and nine turnovers. The Sooners' two post players, Nicole Griffin and Joanna McFarland, combined to go 4 for 23 from the field.

After watching her team's lead shrink from 16 to four while she was out, Griner quickly put the Lady Bears back in control as the national player of the year is accustomed to doing.

Campbell had a pair of baskets during a string of eight straight Oklahoma points that got the deficit down to 57-45 midway through the second half, but Griner stopped the surge with a turnaround jumper in the lane. She also had a layup to start an 8-0 response by the Bears that restored the lead to 69-48.

Destiny Williams chipped in 16 points and Odyssey Sims had 13 points and six assists.

The Lady Bears stumbled with six turnovers in the first 5 minutes, then cleaned up their act to put together a 13-0 run that included a 3-pointer, a fast-break layup and a jumper from the left block by Jordan Madden for a 19-4 edge with 13:25 to go in the first half. But Griner picked up her second foul about 2 minutes later, and coach Kim Mulkey put her on the bench for the rest of the half.

Griner fouled out for just the second time in her college career in the first meeting between the teams this season, even though the Bears were already firmly in control by then, and Mulkey took no chances putting her back in.

About 30 seconds after Griner's second foul, frontcourt partner Brooklyn Pope was called for charging for the second time and also came out.

Baylor didn't make a basket for the first 5 minutes after Griner exited, and Oklahoma took advantage of seldom-used substitutes Kristina Higgins and Sune Agbuke to go on a 14-2 run to get the deficit down to 24-20. Even then, Mulkey didn't make a move to bring Griner back in, and instead it was freshman Alexis Prince that scored eight points over the final 4 minutes of the half to keep the Bears in front 37-30 at halftime.

Oklahoma fell to 0-16 against No. 1 teams.

LGBTs and allies have strongly urged President Obama to act, and on Friday, his administration did, urging the U.S. Supreme Court to strike down the Defense of Marriage Act, which was passed in 1996. At MetroWeekly, Justin Snow writes:

Arguing that Section 3 of DOMA, which forbids federal recognition of same-sex marriage, violates the Constitution, Solicitor General Donald Verrilli writes that DOMA also deserves heightened scrutiny because of the history of discrimination faced by gays and lesbians. ?

The brief also takes issue with arguments advanced by the Republican-controlled House Bipartisan Legal Advisory Group (BLAG), which has been defending DOMA in federal court since the Obama administration stopped doing so in February 2011, including its argument that this is an issue that should not be decided by the courts.

?BLAG makes an appeal to this Court to allow the democratic process to run its course. That approach would be very well taken in most circumstances. This is, however, the rare case in which deference to the democratic process must give way to the fundamental constitutional command of equal treatment under law.

SCOTUS will hear arguments in the case of United States v. Windsor. Edith Windsor is challenging DOMA (beginning in 2010), following the death of her wife, Thea Spyer.

Windsor is suing to recoup about $363,000, the federal estate tax she was forced to pay on her ?inheritance? from Spyer. The federal government does not tax wealth that passes to a surviving heterosexual spouse.

MetroWeekly also reports that on Friday the DoJ filed a brief

? related to the administration?s right to pursue an appeal. BLAG also filed a brief challenging the government?s right to appeal and lawyers for Windsor filed a brief urging the Supreme Court to rule in the case. Oral arguments are scheduled to begin before the high court on March 27 with a ruling expected in June.

Volsky writes that the DOMA brief cites California?s Prop 8,

as an example of the ongoing problem of bias against homosexuals. ?Obama is reportedly considering asking the Court to overturn California?s ban against same-sex marriage before it hears oral arguments in that case on Tuesday, March 26. The Windsor case will be heard on Wednesday, March 27.

DOMA became law in 1996. In 2004, George W. Bush announced his support for a federal marriage amendment. Jim Burroway has a bit of history, at BoxTurtleBulletin:

A great deal has happened 1996, including a growing support from some on the Right, accompanied, of course, by the adamant voices of opponents of LGBT equality. One indication of both, from Joe My God:

Civil Society Groups Help Make Electricity Affordable and Sustainable

Worldwide, one out of every five people lacks access to modern electricity. Affordability, quality of service, and social and environmental impacts pose great challenges in providing people with the power they need for lighting, cooking, and other activities. Good governance involving open and inclusive practices is essential to overcoming these pressing obstacles.

This is part one of a four-part blog series, ?Improving Electricity Governance,? which explores the key components involved in making electricity decision-making more open, inclusive, and fair. The series draws on the experiences of WRI?s Electricity Governance Initiative, which are documented in a new report, ?Shining a Light on Electricity Governance.?

Access to electricity poses major challenges in India. Service varies considerably across the country. In some regions, fewer than 40 percent of people have access to electricity, while half of all rural households lack access to power. These issues will become more challenging as demand for energy is expected to double by 2020. The country will need to figure out how to provide affordable, reliable power in ways that benefit both people and the planet.

But India has a powerful ally in overcoming these electricity challenges: civil society organizations (CSOs).

People?s Monitoring Group of Electricity Regulation Steps In

In the state of Andhra Pradesh, the People?s Monitoring Group on Electricity Regulation (PMGER), a partner with WRI?s Electricity Governance Initiative (EGI), acts as an advocate for affordable, reliable power. The organization is a consortium of NGOs whose constituencies include farmers? organizations, environmental and development advocacy groups, electricity advocacy groups, workers? unions, and research organizations. PMGER ensures that Andhra Pradesh?s electricity decisions are fair, effective, and made with citizens? best interests in mind.

PMGER initially advocated for equitable electricity tariffs, but now participates in other important regulatory areas, such as power purchase agreements and ensuring quality of power supply for various consumer groups. Recently, PMGER analyzed key energy policies in Andhra Pradesh?including the state?s wind energy policies?to identify where gaps may exist in development and implementation processes.

Through this analysis, PMGER determined that shortfalls in the state?s renewable energy development are attributable to unclear timelines and lack of proper reporting and monitoring processes, among other issues. The group then organized public meetings with government officials, disseminating information about the policy?s strengths and limitations and discussing implementation challenges. All of this analysis and work has increased transparency in Andhra Pradesh?s electricity sector, as well as helped other stakeholders make more informed interventions and seek improvements in the policy. PMGER is now using its expertise to build the capacity of other organizations in the area.

CSOs and Better Electricity Governance

Similar to PMGER?s example in India, other EGI partner experiences demonstrate the importance of CSO participation in improving the electricity sector. For example:

  • Kyrgyzstan?s Civic Environmental Foundation (UNISON) has been able to establish itself as a credible stakeholder in electricity decision-making processes. It was appointed co-chair of the government?s new Fuel and Energy Security Transparency Initiative (FESTI) in early 2011. The initiative has increased the government?s engagement with civil society groups, and the electricity sector has begun to show signs of progress. With improved transparency and stakeholder participation, transmission line costs have been reduced by millions of dollars, and electricity distribution losses have been reduced.

  • The Indonesian Centre for Environmental Law and other CSOs led a campaign that was able to convince Indonesia?s Parliament to endorse the 2008 Public Disclosure Act. ICEL provided input to the development of the law, which enhances public access to information and participation in the country?s electricity sector.

Improving Civil Society?s Participation in Governance

As cases in India, Indonesia, Kyrgyzstan, and numerous other countries make clear, CSO participation is a critically important component for improved governance in the electricity sector. CSOs like PMGER are important for helping the public express concerns and opinions in the decision-making processes that directly impact them. Anti-communist oaths persist despite court rulings

OLYMPIA, Wash. (AP) ? It has been just shy of 50 years since the U.S. Supreme Court ruled that a Washington state law barring members of the Communist Party from voting or holding public-sector jobs is unconstitutional.

Evidently, that is not enough time to remove it from the books.

Washington is one of a handful of states with similar laws still in existence despite their having been declared unconstitutional decades ago.

With few exceptions ? most notably Georgia, where an anti-communist oath was administered to incoming Dunwoody City Councilmembers as recently as last year ? the laws are treated as part of a bygone era, not unlike state statutes prohibiting interracial marriage, the last of which was removed from Alabama's books in 2001 even though the Supreme Court ruled them unconstitutional in 1967.

Rep. Joe Fitzgibbon, D-Burien, first introduced a measure to repeal Washington state's anachronistic anti-subversives law last year, figuring, he says, that it would be an unceremonious end to a dead-letter statute originating from a dark period in our nation's history.

He was wrong. Though his bill passed out of the House Judiciary Committee, it did so on a party-line vote, with four Republicans opposed.

With only so much political capital to expend on contentious legislation, House Democratic leaders declined to move it forward, and it never made it to the floor for a vote.

This year, Fitzgibbon lowered his sights, introducing House Bill 1062 with the understanding that it likely would not even get out of committee.

By the end of Friday, as a key deadline for policy-related bills passed without the bill coming up for a committee vote, that understanding was confirmed.

"There are some (Democratic lawmakers) that think this is a bad political issue for us, but I really don't," he said. "I don't think there is a lot of fear in our state these days about the prospects of a communist takeover."

That may be, but several decades removed from the Red Scare, any suggestion of kowtowing to communists can still inflame passions.

After Fitzgibbon spoke in favor of the bill in the House Judiciary Committee earlier this month, Rep. Matt Shea, a conservative Republican from Spokane Valley, was ready with a sharp rejoinder.

"For the large Ukrainian, Russian, North Korean and Chinese populations in the state who fled communism ? including my wife, whose father was arrested by the KGB, who suffered horrible persecution, whose friends were sent to the gulag in Russia ? do you see this as a little bit of a slap in the face to them that communism is not subversive?"

Responded Fitzgibbon: "I don't believe we persecute people based on their political beliefs in Washington state, and I would say that applies to communists as well as anybody else."

In addition to Washington state and Georgia, Pennsylvania and California have laws requiring state workers to take an oath swearing they are not subversives or members of a group dedicated to overthrowing the government. At least five other states ? Connecticut and Virginia among them ? have laws prohibiting subversives from working in emergency management. Illinois has a statute barring communists from seeking elected office.

Thanks to a series of 1960s U.S. Supreme Court rulings that found them to be unconstitutional, those laws have long been all-but unenforceable.

The ruling that struck down Washington state's statute on subversive activities, handed down in 1964, found that the definition of a subversive group was too vague.

Three years later, the Supreme Court ruled that Eugene Frank Robel, a worker at the Todd Shipyard in Seattle, had been wrongly fired from his job building warships over his membership in the Communist Party.

"Robel put the nail in the coffin" for laws limiting communists from public-sector jobs, says University of Washington Law Professor Stewart Jay. "If you can't fire (a communist) working in national defense, what can you do?"

But while the Supreme Court struck down loyalty oaths that predicate public-sector employment on a lack of affiliation with a subversive group, it has upheld less-expansive pledges to defend the United States from its enemies and uphold the Constitution.

Including those that also have anti-subversives oaths, at least 13 states have such laws on their books, including Florida, Tennessee and Arizona.

In California, Marianne Kearney-Brown, a math instructor at California State University East Bay who refused to take such an oath as a Quaker and a pacifist was fired from her post in 2008 before swiftly being reinstated and assured that she would not be forced to take up arms.

Periodically, a lawmaker seeking to stem the perceived tide of cultural decline will propose a new loyalty oath. Last month, a Republican state lawmaker in Arizona, Rep. Bob Thorpe, proposed legislation requiring high school students to swear an oath defending the Constitution before being allowed to graduate. That measure, House Bill 2467, is pending.

In general, though, such efforts are on the wane ? a state of affairs not lost on communists themselves.

"It's a good thing to get rid of these laws," says Libero Della Piana, vice chair of the Communist Party USA. "But the reality is that people are more worried about foreclosures on their houses than subversives in student government."

Glasgow University students vote no in mock Scottish referendum ballot

A MOCK referendum by university students has found almost two thirds against an independent Scotland.

Organisers of the Glasgow University poll said 63 per cent voted No when asked the question: "Should Scotland be an independent country?"

The remaining 37 per cent voted in favour of independence.

The university's Dialectic Society, which ran the mock vote, said 2,589 students voted, with eight spoiled ballots.

Polling took place throughout the day at three university sites.

The result was announced following a debate at the student union with Yes Scotland chief executive Blair Jenkins and Labour MSP Jackie Baillie.

Mr Jenkins said: "The students who worked hard for a Yes vote fought a very positive, optimistic and efficient campaign.

"While I am disappointed for them, we have to remember that some 2,500 out of 20,000 students actually cast votes and this undoubtedly reflects the fact that a large section of the student and general population has yet to make up their minds.

"We have made considerable progress in recent polls and we will continue to work tirelessly to convince people, including our students and younger citizens who have the biggest stake in securing a better future, that we have nothing to fear and everything to gain from being a normal, independent country."

Carys Hughes, a representative of the Glasgow University Better Together campaign, said: "Our campaign was led by the students and wasn't consumed by party politics.

"We talked about the issues. The other side seemed to think that having (Deputy First Minister) Nicola Sturgeon on the campus for a whole day would win them the day.

"I think the opposite happened. It was because they did this, because they took the campaign away from the students, that they lost."

Duncan Crowe, who is on a law conversion course at the university, voted yes.

The 27-year-old from Rutherglen, South Lanarkshire, said: "At the moment the debate is pretty balanced.

"Voting maybe wasn't an option so I thought I'd vote the way that would be most efficacious for furthering the discourse."

Catriona Boyd, 21, from Peebles voted against independence.

The law student said: "My vote could change, it is still really early.

"I think we do well being part of the UK, but I'm going to put in some research before the vote next year.

"It's such a big decision."

During the debate Ms Baillie faced booing and shouting from some of the around 300 students packed into the gallery of the debating chamber, while Mr Jenkins received several rounds of applause and cheering as he spoke.

Mr Jenkins told the students that the vote constituted a "fantastic opportunity" for the younger generation and that the best future for Scotland was as an independent country.

"This is an opportunity to think about what kind of country we could be and should be," he said.

In her speech Ms Baillie, MSP for Dumbarton, spoke out against the SNP, telling the audience the party had no consistent economic policy.

A man in the gallery shouted: "It's not about the SNP, it's about independence."

When the politician went on to list the achievements of Scotland as part of the union, others in the gallery shouted "Iraq" and "Afghanistan".

Also taking part in the debate were independent MSP Jean Urquhart, who underlined the importance of discussing a national constitution for Scotland in the run-up to the 2014 vote.

She said: "If people in this country are to have a say politically and change Scotland for the better, then I'd be voting yes."

Labour MP William Bain and journalist Lesley Riddoch also gave their views in the debate.

Speaking after the results, Ms Baillie said: "The Glasgow University students have spoken quite emphatically and said that yes they prefer a strong Scotland, but one that is firmly within the United Kingdom.

"I think tonight's result is actually mirrored in most communities across Scotland."

She said of the heckling: "I am used to being shouted down in parliament by the SNP.

"Perhaps Holyrood is slightly more sedate than this evening but I have to say that I loved every minute of it."

Liberal Democrat MP Charles Kennedy, who is rector of the university, said: "First and foremost, the real winners today are the democratic process itself and the historic reputation of the University of Glasgow in the lineage of the national debate down the generations.

"So my congratulations to the student bodies who showed such a lead here - and to the 2,500 students who voted.

"The real lesson is the extent to which students wanted to hear more of the detail and the arguments involved. Both sides need to campaign positively."

France ready to start Mali withdrawal despite Gao attack: admiral

OTTAWA (Reuters) - France is still ready to start pulling its forces out of Mali next month despite a rebel attack on the key town of Gao, the French commander of the defense staff said on Friday.

Admiral Edouard Guillaud told reporters after a speech in Ottawa that he was not surprised by Thursday's attack in Gao, when 15 Islamists were killed by French and Malian troops.

Asked whether France still planned to start withdrawing troops in March, he replied: "This is obviously conditions-based, that's obvious. But yet, I don't see any reason not to begin some drawdown."

"Batman/Superman" is set to debut in June and will be written Greg Pak and illustrated by Jae Lee. It will focus on how the two iconic heroes first met in the publisher's relaunched universe, dubbed The New 52.

Pak says DC is giving he and Lee "some real leeway to do some really important storytelling" in the series that will give readers the opportunity to delve deep into the characters, their interaction and the effects on the wider New 52 universe.

The two characters have been a part of DC since the late 1930s.

Northam Platinum H1 headlines EPS falls 30.1 percent

JOHANNESBURG (Reuters) - Northam Platinum, one of South Africa's smaller platinum producers, reported a 30.1 percent fall in first-half headline earnings as finance and tax charges swelled.

Headline earnings per share for the six months to end December were almost a third lower at 36.3 cents from 51.9 cents in the first half of its previous year.

Headline EPS is the key measure of profitability in South Africa and strips out certain one-off and non-trading items.

Production of precious metals in concentrates climbed 6.5 percent to 157,183 ounces and precious metals sales grew 4.4 percent to 177,655 ounces.

Northam managed to escape last year's violent labour unrest unscathed but its future will be impacted by the crisis in the South African platinum sector.

"Against the background of a volatile labour relations climate in the South African mining sector, Northam's results reflect a sustained operational recovery at the company's Zondereinde mine," Northam said.

Threats of a worldwide shortage of platinum group metal (PGM) supplies from South Africa helped to stem the decline in the dollar prices of PGMs.

The weakening of the South African rand against the US dollar also played a hand in improving the rand basket price, which helped push up revenue.

While social and economic uncertainty is expected to dominate the platinum industry's agenda this year the company said it would deliver an improved operational performance compared to the previous year.

Northam did not declare an interim dividend, choosing instead to ensure it has enough cash for the 4 billion rand development of its flagship Booysendal mine.

It also wants to cushion itself against the uncertainty in the South African mining industry.

The company's shares have gained 20.86 percent in the past 12 months, while the JSE's Platinum Index has fallen 13.10 percent.

A massive decline in earnings have been reported across the platinum sector as the larger producers struggle to regain their footing after their operations were brought to their knees by extended illegal strikes late last year.

More than 50 people were killed in labour unrest last year.

I liked the fact that the love came first.? In so many of those other books (including others with ?love? in the title), discipline is the primary goal and love the second, but that wasn?t going to work for me?not for this kid.? Amidst the sea of all that I didn?t know, I always knew that love and attachment trumped all.? There would be no healing, controlling, or disciplining until this child trusted me and was filled to the brim with love.? I bought the book and read it cover to cover in one night.? The next day I started implementing its strategies and I haven?t looked back since.

6/18/2010:? We celebrate 6 months as a family.??We have made it through the darkness.? There are still struggles and temper tantrums, but life has become manageable again.? 9/12/2010:?Epic meltdown at church moments before we were supposed to head to a picnic complete with running wildly into oncoming traffic.? This is the part of the?roller coaster?ride that I find particularly intolerable.? The fact that?we?ve?gone months without a public tantrum, then all of a sudden, here it is again.? It feels like such a lack of progress ? it feels like such a failure.? I really wanted to go to that picnic.

Eliminating malaria has longlasting benefits for many countries

Feb. 21, 2013 ? Many nations battling malaria face an economic dilemma: spend money indefinitely to control malaria transmission or commit additional resources to eliminate transmission completely. A review of malaria elimination conducted by researchers at the Johns Hopkins Malaria Research Institute and other institutions suggests stopping malaria transmission completely has longlasting benefits for many countries and that once eliminated, the disease is unlikely to reemerge over time. Furthermore, total eradication of malaria may not be necessary before countries that eliminate the disease within their own borders can rely on their health systems to control cases.

The study is published in the February 22 edition of Science.

"Our research identified a number of changes that could explain the stability of malaria elimination. The key for us now is to determine whether elimination caused some of these changes, and to identify other countries where elimination could become a stable endpoint," said the study's senior author, David Smith, PhD, MS, professor in the Department of Epidemiology and the Malaria Research Institute at the Johns Hopkins Bloomberg School of Public Health.

For the analysis, the researchers examined outcomes of the Global Malaria Eradication Programme, with activities starting in the late 1940s. When the program was defunded in 1969, the majority of countries that had achieved elimination stayed that way, while most countries that did not eliminate the disease continue to battle malaria today. The study analyzed data from countries that eliminated malaria, describing nearly a quarter of a million imported malaria cases?usually acquired during travel-compared with only about five thousand malaria cases transmitted in-country. Malaria transmission in elimination countries is rare today.

The researchers developed six hypotheses as to why malaria elimination remains stable over time. Among the reasons, researchers question whether economic development spurs a reduction in malaria transmission, independent of disease control measures, or if economic development is a byproduct of reduced illness from malaria. Other hypotheses consider benefits of mosquito control measures, effectiveness of outbreak management, and population travel patterns as reasons for keeping importation of new malaria infections low.

"If malaria elimination helps cause its own stability, then eradication may benefit from regional coordination, but it does not require a globally coordinated campaign. Malaria elimination can proceed like a ratchet, country-by-country and region-by-region, culminating in global eradication," explained Smith.

The researchers were funded by grants from the Bloomberg Family Foundation, the National Institute for Allergy and Infectious Diseases at NIH, the Bill & Melinda Gates Foundation, the U.S. Department of Homeland Security, the Fogarty International Center at NIH, and the Wellcome Trust.

U.S. indicts peanut processors in 2009 salmonella outbreak

WASHINGTON (Reuters) - Federal prosecutors said on Thursday they brought criminal fraud and conspiracy charges against peanut company employees tied to a 2009 salmonella outbreak blamed for nine U.S. deaths.

The charges filed in U.S. District Court in Georgia on Wednesday included fraud, conspiracy and the introduction of adulterated and misbranded food into interstate commerce, according to court papers.

The contaminated peanut products forced one of the biggest recalls in U.S. history. Federal health officials said 700 people in 46 states were infected, with nine deaths.

Peanut Corp of America was liquidated after the outbreak and is no longer in business.

Internal company messages in 2009 showed owner Stewart Parnell complaining about lost profits while the food poisoning was investigated. He later refused to testify after U.S. lawmakers subpoenaed him to appear at a hearing.

Parnell, 58, was among five people charged, including with obstruction of justice.

The Justice Department said he and three other company officials participated in a scheme to ship what they knew were salmonella-contaminated peanuts and peanut products, misleading customers and putting them at risk.

"When those responsible for producing or supplying our food lie and cut corners, as alleged in the indictment, they put all of us at risk," Stuart Delery, head of the Justice Department's Civil Division, said in a statement.

Neither Parnell nor his lawyer could immediately be reached for comment.

Some of those affected by the outbreak welcomed the criminal charges, having asked for them four years ago.

"I'm ecstatic. I would equate it to wishing for something to happen more than anything else you ever wanted in life and waiting years for it to occur," said Jeff Almer, whose mother died after eating peanut butter.

"This has been my life's mission for the last four years since my mom died - to try to get some justice," he said.

Randy Napier, whose mother also died after eating contaminated peanut butter, said he had been frustrated because the Justice Department was tight-lipped as it moved toward the indictments. He began to doubt there would be action.

"I feel relieved that our Justice Department was doing their job," he said from North Carolina. "I can finally actually put my mom to rest."

ONE GUILTY PLEA

One of those charged, Daniel Kilgore, 44, pleaded guilty on Wednesday, prosecutors said.

Kilgore was operations manager of the company's plant in Blakely, Georgia, from 2002 to 2008. He waived an official indictment and admitted to fraud, conspiracy and introduction of adulterated food into commerce, prosecutors said.

Two other Peanut Corp of America employees face charges: Samuel Lightsey, 48, the Blakely operations manager after Kilgore, and Mary Wilkerson, 39, a quality assurance manager.

A fifth person, Michael Parnell, 54, a food broker at P.P. Sales who worked on behalf of the peanut company, was also charged.

When inspectors from the U.S. Food and Drug Administration visited the Blakely plant in January 2009 after the initial outbreak, Parnell, Lightsey and Wilkerson lied about what they knew, prosecutors said.

A conviction for fraud or obstruction of justice carries a maximum prison sentence of 20 years, while illegally introducing tainted food into interstate commerce carries a three-year maximum, Michael Moore, the U.S. Attorney for the Middle District of Georgia, said at a news conference in Washington.

Actual sentences could be much lower depending on prior criminal past and other factors. Moore said he expects those charged to appear in court within the next week.
