Was it even remotely possible that I was a candidate for skin cancer??

According to new research from L?Or?al, the answer is yes. The fact is, exposure to sunlight induces DNA damage in all skin types?regardless of ethnic origin?and new skin-cancer statistics are frightening: Incidences of melanoma amongst people of color are on the rise, and in the case of Hispanic women, the rate of increase is particularly high. ?There?s an overriding perception that only Caucasian people can get skin cancer, and that?s not true,? says Mona Gohara, M.D. assistant professor of dermatology at Yale, who is of Egyptian origin herself. ?When people of color do get it, it?s generally more deadly because it?s usually diagnosed at a later stage.????

She stresses the importance of annual mole checks at your dermatologist?s office, as well as monthly self-exams (with special attention paid to the melanoma-prone areas like the palms of the hands, soles of the feet, nails, and scalp).?

Preventative measures are also key. If the minimum daily recommended protection is SPF 30, then clearly sunscreen should be a part of everyone?s skin care regimen. And while slathering on a broad-spectrum formula for a day at the beach is essential, cumulative damage adds up, too. As Gohara points out, the sun?s harmful rays can filter through car and office windows, and there is evidence to suggest that artificial light worsens dark spots, which are especially problematic for women of color (who are more susceptible to hyperpigmentation). In fact, scientific research shows that even the darkest skins only have an inherent SPF of about 13.4 versus 3.4 in those on the flip end of the spectrum.?

On, April 2, 2012, Debtor BTR Properties LLC (?BTR?) filed a voluntary petition for Chapter 11 relief, including schedules and statements. The petition was filed and signed by Brian T. Roberts (?Roberts?), sole member of BTR. The petition did not include the signature of any attorney for BTR. Under the ?Type of Debtor? portion of the petition, the ?corporation? box is checked, which includes an LLC, and also indicates that this is a Single Asset Real Estate case as defined in 11 U.S.C. ? 101(51B). Prior to the filing of this case, Roberts also filed a petition for Chapter 11 relief on November 4, 2011, listing himself (individually) as the debtor. [1]

On April 4, 2012, the Office of the Clerk of Court sent BTR (c/o Roberts) a letter stating that BTR must be represented by an attorney in this bankruptcy case pursuant to SC LBR 9011-2. The letter also stated that:

Unless you have your attorney file in this office, within ten (10) days of the date of this letter, a notice of appearance of representation of your partnership, corporation or other business entity in this matter, the Court will enter orders as it deems appropriate, which may include dismissal of the document you filed and imposition of sanctions. [2]

Roberts filed a Response with the Court on April 9, 2012, objecting to the requirement that BTR be represented by counsel and the Court scheduled this Status Hearing. [3] The Response attached a document titled ?SC Revenue Ruling 91-11,? [4] which states that ?[a] limited liability company (LLC) is an unincorporated business association. . .? The Response also attached a document from the Internal Revenue Service stating that ?[a]n LLC business entity must file a corporation, partnership or sole proprietorship tax return.? [5] From these documents, Roberts and/or BTR claim that as a single member LLC, which is operated as a sole proprietorship, BTR may be represented by Roberts because SC LBR 9011-2 allows an individual to ?represent an unincorporated business if that individual is the sole proprietor of that business.? SC LBR 9011-2(b).

Roberts? reliance on the authorities set forth in the Response is misplaced. Section 12-2-25 states that ?for South Carolina tax purposes: (1) a single-member limited liability company, which is not taxed for South Carolina income tax purposes as a corporation, is not regarded as an entity separate from its owner . . .? S.C. Code. Ann. 122-25(B) (emphasis added). As the statutory language plainly states, this only affects state tax purposes and, therefore, is inapplicable here.

Further, if BTR were in fact a sole proprietorship?as mentioned in document filed by Roberts (which is not the case)?then its assets and liabilities would already be a part of Roberts? bankruptcy estate and this additional bankruptcy would be superfluous. See Moore v. Moore, 360 S.C. 241, 259, 599 S.E. 2d 467, 476 (Ct. App. 2004) (stating that as a sole proprietor, the owner?s personal income and the business?s income are the same and the owner?s ?personal expenditures are probative as to his business?s financial viability.?).

The Federal Rules of Bankruptcy Procedure provide that ?[e]very petition, pleading, written motion, and other paper, except a list, schedule, or statement, or amendments thereto, shall be signed by at least one attorney of record in the attorney?s individual name. A party who is not represented by an attorney shall sign all papers.? Fed. R. Bankr. P. 9011(a). While individuals in bankruptcy or other court proceedings may represent themselves, the same prerogative is not afforded to corporations and other certain business entities. It is well-established law that those entities must be represented by a licensed attorney because they are fictional legal persons; therefore, they cannot appear for themselves personally. See Rowland v. Cal. Men?s Colony, 506 U.S. 194, 2010-2, 113 S. Ct. 716, 721, 121 L. Ed. 2d 656 (1993) (?It has been the law for the better part of two centuries, for example, that a corporation may appear in the federal courts only through licensed counsel.? (citations omitted)).

?Pursuant to 28 U.S.C. ? 1654, bankruptcy courts have the statutory authority to regulate who may appear before them.? In re Wile, C/A No. 09-04657-JW, slip op. at 2 n.3 (Bankr. D.S.C. Sept. 9, 2010). Consistent with the long-established rule described in Rowland, the South Carolina Local Bankruptcy Rules require that ?[a]ll partnerships, corporations and other business entities must be represented by an attorney duly admitted to practice as specified in SC LBR 2090-1, except with respect to the filing of proofs of claim or interests and reaffirmation agreements.? SC LBR 9011-2(b); see also Local Civil Rule 83.1 IX.02 DSC (authorizing Bankruptcy Judge of the District of South Carolina ?to make such rules of practice and procedure as they deem appropriate.?). This rule is also recognized under South Carolina state law. See Renaissance Enters., Inc. v. Summit Teleservices, Inc., 334 S.C. 649, 653, 515 S.E.2d 257, 259 (1999) (holding that a non-lawyer is not allowed to represent a corporation in state circuit or appellate courts).

An LLC, such as BTR, is a type of business entity that is ?a legal entity distinct from its members.? S.C. Code Ann. ? 33-44-201. Therefore, like other business entities, BTR can appear in court only through a licensed attorney. Monster Daddy, LLC v. Monster Cable Prod. Inc., 2008 U.S. Dist. LEXIS 54406 (D.S.C. 2008) (?It is well established that a limited liability company is an artificial entity that cannot appear pro se and must be represented by counsel.?); see also In re 1103 Norwalk St., L.L.C., 011-0059C-7G, 2003 WL 23211564, at *1 (Bankr. Boehner: House will go ahead with contempt vote

WASHINGTON (AP) ? Speaker John Boehner (BAY'-nur) says the House will move forward with a contempt of Congress vote against Attorney General Eric Holder over the botched gun-tracking operation known as Fast and Furious.

The Ohio Republican told reporters Wednesday that last-minute talks with the White House about releasing documents had failed to avert the vote. President Barack Obama has asserted executive privilege to keep the documents secret, but Republicans say there's no basis for that.

The issue has political implications this election year. The National Rifle Association is keeping score, prompting some Democrats to join Republicans in voting for contempt. Such a citation would not cause the release of more documents on the operation, in which guns were allowed to "walk" from Arizona to Mexico in hopes they could be tracked.

How to get a refund on an app from Google Play beyond the 15 minute time window

See, sometimes there is method to my madness! After being a ~~little~~ lot stupid and buying a crappy $200 Vuvuzela app from the Google Play store on Sunday (see video above), I thought I kissed that money goodbye. I failed to remember you can easily get refunds out of the Googe Play store within 15 minutes of purchase just by going back to the app and tapping the Refund button. D'oh! By the time Phil reminded me about this later in the day, hours had already passed, so we both assumed I was out of luck.

Turns out that's not the case though. While the 15 minute refund is a no-hassle, no-questions asked refund policy, you can actually request an app refund beyond the 15 minute time window. As I type this it's almost 30 hours after I bought the Vuvuzela app, and I just requested the refund and was issued it within minutes. I'm sure many of you out there are familiar with this process already, but for those who are not keep reading for the details!

50 cent is "doing fine" after his SUV was?rear-ended by a Mack truck?early Tuesday on the Long Island Expressway in New York.?

A spokesperson?told TODAY.com the rapper "was taken to New York Hospital Queens where he was treated for minor neck and back injuries. He was released this morning and is doing fine."

?Thisis50.com, a site with ties to?50 Cent's official website,?published photos of?the musician?in a neck collar and on a stretcher. The site also reports that the truck driver told police his load shifted and he lost control of the vehicle. Photo show a large hole in the front of the truck and damage to the rear of?the musician's?black SUV.

The driver of 50 Cent's car was also taken to the hospital. There was no word on his condition.

Greek PM cannot attend EU summit due to surgery

ATHENS, Greece (AP) ? Greece's new prime minister will not be well enough to travel to a critical EU summit in Brussels after undergoing an eye operation, the government said Sunday.

Antonis Samaras, 61, underwent surgery for a detached retina for nearly four hours Saturday, just three days after being sworn in at the head of a three-party coalition government formed after two inconclusive general elections.

The doctor treating the prime minister, Panagiotis Theodosiadis, has ruled out him being able to travel to Brussels for the June 28-29 European Union summit, government spokesman Simos Kedikoglou said.

"Before the surgery, (Samaras) said, 'You do your job, and I do mine, which is to go to the EU summit,'" Theodosiadis said of Samaras. 'I was hoping (Saturday) that he would announce he would not go because it was a very delicate operation. ... He needs to lie at a certain angle for a certain period each day, for at least a week. He can do meetings, but he certainly can't walk," Theodosiadis said, adding that his patient would leave the hospital Monday.

Samaras has appointed new Foreign Minister Dimitris Avramopoulos to head the Greek delegation at the meeting, Kedikoglou said.

The summit could prove a key test of Greek leaders' pledges to renegotiate some terms of the country's international bailout.

Reports that the so-called troika of Greece's lenders ? the European Commission, the European Central Bank and the International Monetary Fund ? will postpone the visit of its delegation, originally planned for Monday, were not confirmed by Samaras' office. European Commission spokesman Amadeu Altafaj Tardio said that troika staff "will be moving to Athens starting (Monday)."

The debt inspectors are due to review the country's fiscal situation and resume talks that had been put on hold during the country's nearly two-month political deadlock.

Greece's incoming finance minister, Vassilis Rapanos, was also hospitalized Friday after suffering a collapse. A hospital spokeswoman said he was expected to be discharged either late Monday or Tuesday after further tests. But because his swearing in had to be postponed due to his ill-health, outgoing Finance Minister Giorgos Zanias still holds the title and will attend the summit.

Zanias, who was a key negotiator for Greece's bailout deal before being named to the post, will be accompanied by Development Minister Costis Hatzidakis and Alternative Finance Minister Christos Staikouras.

Zanias himself had suffered chest pains and high blood pressure and was hospitalized in October at an EU summit, where he had accompanied then-Finance Minister Evangelos Venizelos. The doctors had said he had suffered an anxiety attack. Four days later, an adviser to then-Prime Minister George Papandreou suffered a heart attack during negotiations on Greece's second bailout deal.

Greece has been dependent since May 2010 on funds from two international rescue loan deals with other European Union countries and the International Monetary Fund, in return for which it imposed a series of deep spending cuts and tax hikes.

Anti-bailout parties made massive gains in Greece's May 6 and June 17 elections, with Greeks furious at the drop in living standards by measures that have left the country struggling through a fifth year of recession and sent unemployment spiraling to above 22 percent.

Samaras' conservative New Democracy party came first in both elections, but without enough votes to govern alone. Coalition talks collapsed after 10 days in May, leading to the second ballot.

New Democracy is now in a power-sharing government with longtime socialist PASOK rivals and the small Democratic Left.

The new government on Saturday issued a policy statement outlining what it aims to change in its bailout conditions, saying it would seek to repeal some taxes, halt layoffs and extend by two years the mid-2014 deadline for tough austerity measures.

"The general aim is no more cuts to salaries and pensions, no more taxes," the statement said, adding the government would not carry out any public sector layoffs.

Whether the government can deliver on its pledges will depend on how they are viewed by Greece's international creditors. Germany, the largest single contributor to the bailout, has repeatedly said Athens must stick to its austerity targets.

German Finance Minister Wolfgang Schaeuble repeated this view Sunday, in an interview to newspaper Bild am Sonntag.

"It must now be the most important task of Prime Minister Samaras' new government to swiftly and immediately implement the agreed program without hesitation or asking, yet again, what the others could do in addition for Greece," German Finance Minister Wolfgang Schaeuble was quoted as saying. "The ball is in Greece's field; it is in their hands to achieve that Europe's citizens can regain trust. But this will only be achieved through concrete measures and actions."

The Sunday tabloid published a survey on Greece that it had commissioned with Italy's Corriere della Sera, Spain's ABC and France's Le Journal Du Dimanche.

In it, 78 percent of the Germans polled, 65 percent of the French and about a half of the Italians said Greece should leave the eurozone if it fails to pay its debt.

In the Washington Nationals stacked rotation, Edwin Jackson is often a forgotten man, but he has pitched much better than his 3-4 record would indicate.

Jackson has an ERA of 3.02, which is on pace to be his lowest in six years as a starter. He's often been dominant, as hitters are batting just .213 against him, eighth-best in the National League.

The right-hander has allowed two earned runs or fewer in four consecutive starts. He was the hard-luck loser on June 17 against the Yankees, going six innings while allowing seven hits and two runs.

Jackson has had success against the Orioles in his career, going 5-1 with a 3.25 ERA in 10 games, though he has a 5.16 ERA in 22 2/3 innings at Camden Yards.

For the Orioles, Wei-Yin Chen will attempt to win his fourth straight game for the first time in his major league career.

The Taiwanese lefty is coming off arguably his best performance as an Oriole on June 17, earning the win over the Braves by tossing seven scoreless innings.

Chen's seven wins is tops on the team, and his 3.36 ERA is second to only Jason Hammel's 2.87 among Oriole starters.

In Friday's series opener, the Orioles came out on top, 2-1, behind another masterful performance from Jason Hammel.

Hammel (8-2) followed up a shutout on June 16 with an eight- inning gem, allowing five hits and no earned runs while striking out 10. In the process, he lowered his season ERA to 2.61.

"His outings the last two times out, and really most of the year, have been fun to watch," Orioles manager Buck Showalter said. "When you have command of that many pitches in your repertoire and you put him and (catcher Matt) Wieters on the same team, you like your chances. He was outstanding."

Baltimore got out to an early 1-0 lead after a Mark Reynolds home run in the bottom of the second, his sixth of the year.

The Nationals tied the game up 1-1 with a Roger Bernadina RBI groundout in the top of the fifth, only for the Orioles to respond in the bottom of the inning with a J.J. Hardy RBI double, which proved to be the game winner.

Jim Johnson pitched a scoreless ninth inning for his 21st save.

Jordan Zimmermann (3-6) pitched well in defeat, allowing two earned runs and eight hits over seven innings of work.

The win for the Orioles snapped a three-game losing streak, and they are just 1 1/2-games behind the Yankees for first place in the AL East.

With a deadline looming, the City Council was expected to resume negotiations Sunday over Mayor Bloomberg?s proposed $68.7 billion budget.

?By July 1, we need to have an adopted budget, so it could happen at any time,? said Jamie McShane, a spokesman for Council Speaker Christine Quinn.

On the line are more than 42,000 child care and afterschool slots for families who qualify for the city?s financial aid.

For the fourth year in a row, fire companies are also on the block.

Public libraries, cultural institutions and services for senior citizens and for New Yorkers with AIDS remain at risk as lawmakers wrangle over a finalized spending plan for the next fiscal year.

The Council was expected to use some funds it controls to restore some of Bloomberg?s proposed cuts.

Dozens of lobbyists crowded the typically quiet City Hall entry this past week, waiting to catch a word with a City Council member heading into negotiations.

Many said they?d be back at City Hall Sunday to resume talks.

?The mayor can and should stop the dance by providing sufficient funds for nonprofits serving low-income New Yorkers, and by demanding that banks and the wealthy pay their fair share,? said Patrick Markee, senior policy analyst with the Coalition for the Homeless.

Bloomberg?s budget includes $1 billion in revenue from selling 2,000 new yellow-taxi medallions, but the proposal has been stalled by a court challenge.

The medallions are part of Bloomberg's plan to expand taxi service in the outer borough?s and northern Manhattan.

The budget agreement is usually sealed with a handshake a few days before the July 1 deadline.
